Minister Alexandre de Moraes, of the Federal Supreme Court, denied the request for unrestricted access by the brother of former first lady Michelle Bolsonaro to the house where former president Jair Bolsonaro is under house arrest, in Brasília. According to Moraes, there is no justification for making an exception to the ban on visits to former president Carlos Eduardo Antunes Torres.
Moraes highlighted that visits to the former president were restricted for “health reasons”, due to the former president’s “need for greater isolation” so that he could recover from bronchopneumonia. The minister also highlighted that the authorization for the presence of other people in the house was limited in an “exceptional and specific” way, with no reason to relax the rules for Carlos Eduardo.
Bolsonaro’s defense had asked for unrestricted permission for Michelle’s stepbrother to be present at the former chief executive’s house so that he could “help the family”. The lawyers maintained that he would act as ex-president Bolsonaro’s companion, especially at times when the former first lady was not in the house.
However, according to Moraes, Bolsonaro’s own defense admitted that Michele’s brother is not a health professional and that his presence, at the former president’s house, would not be aimed at medical care, but rather at helping with domestic tasks and
family members. The judge also noted that, in addition to the house staff, security guards “provided by the State itself” accompany Bolsonaro 24 hours a day.
According to the minister, the “difficulties” of the family routine are “understandable” but do not justify expanding the list of people who are authorized to frequent the house where Bolsonaro is serving his sentence, “at the risk of distorting the very essence of custody”.

“The nature of house arrest, even if humanitarian in nature, imposes restrictions and strict control on who accesses the custodian’s residence, aiming to guarantee supervision and the purpose of the measure. Flexibility to allow the entry of people who do not fit into the strictly authorized hypotheses would represent an undue relaxation of the conditions established for serving the sentence under home confinement”, noted the minister.
In the same order, Moraes gave approval for the visit of two lawyers to Bolsonaro, simultaneously, when representatives of the former president who are from São Paulo are, exceptionally, in Brasília.
