The rapporteur states that intervention by the Judiciary to silence speech should be “reserved for extreme situations”
The 5th Civil Class of the (Court of Justice of the Federal District and Territories) rejected, on Wednesday (April 15, 2026), the appeal of the former first lady to of the former deputy (Podemos-SP). The request for urgent exclusion had already been denied in the first instance.
Judge Leonor Aguena, rapporteur of the case, took the case to the plenary for analysis. The board voted unanimously to maintain the decision that denies the removal of the content. Read (PDF – 104kB).
In the rapporteur’s text, she states that the intervention of the Judiciary to “Silencing criticism of political agents or public figures should be reserved for extreme situations of hate speech or blatant misinformation, which is not undeniably true at this initial stage”.
In the video that motivated the legal action, Joice Hasselmann calls Michelle “hollow dick saint”, “lover” and claims that the former first lady has “past dirtier than chicken coops”.
To the Poder360in September 2025, the former deputy mocked the request for urgent protection and said that the former first lady will not be able to “erase your past”. He also said he trusted the judgment of the Court.
“Crying is free. Michele, the wife of the convicted Jair Bolsonaro, cannot erase her past. And in Brasília, even the stones of Praça dos 3 Poderes know that the ‘saint’ is from the hollow stick. […] How many pieces of jewelry did Michelle not pocket that belonged to the public authorities? We only found out about the set of diamonds because the IRS picked it up. What about those who weren’t caught?”said Joyce.
Until Monday (April 20), the former first lady had not publicly commented on the decision.
