The deputy Paulinho da Força (Solidariedade-SP) called this Thursday (23) the veto of the Dosimetry PL of “Lula’s revenge”. The president’s refusal to the bill that reduces sentences for those convicted of the January 8 coup attempt will be discussed by Congress on the 30th.
For the congressman, the tendency is for the Legislature to reach the votes to make it count next week.
“The session will be remote, therefore, even more difficult. We have to work. Talk to the leaders, so that we can. The tendency is to increase the number of votes. We must pass 300 votes in the Chamber and a little more than 50 in the Senate. People are more convinced that it is necessary to get this issue out of the way. It was President Lula’s revenge, so we need to overturn it”, he stated.
He also said he believes that the text will be judicialized and denied that it is an “amnesty” for those convicted, but a middle ground.
The focus of the proposal is to reduce the calculation of penalties applied. To this end, the text lists conditions and sets minimum percentages for compliance with the sentence and regime progression. To avoid “legal uncertainty”, the rapporteur also stated in the proposal that the redemption of time could be compatible with house arrest.
According to the text, if the person is convicted of “exercising command, individually or collectively, of a criminal organization structured to commit a heinous or similar crime, at least 50%” of the sentence must be served.
This would be , sentenced to 27 years and 3 months in prison by the STF (Supreme Federal Court). This is because, when defining the penalty, leadership of a criminal organization was considered as an aggravating factor.
