The Regional Electoral Court granted an injunction ordering the removal of content from social networks of state deputy Antonio Donato (PT) for early electoral propaganda.
The request was made by the Republicans, the governor’s party. The representation pointed out that two posts by Donato on Facebook, boosted by payment, contained a message favorable to pre-candidate for governor Fernando Haddad (PT) and critical of Tarcísio before the period allowed by legislation, which begins in August.
“As can be seen from the initial statement and the documents that support it, the contested contents were published on social media, with promotion, for the benefit of pre-candidate Fernando Haddad, containing, among other expressions, the statement: ‘we are going to win this election'”, says the case’s rapporteur, Maria Claudia Bedotti.
The decision states that “the danger of damage arises from the very nature of early electoral propaganda in a digital environment, compromising the equality and parity of arms that should govern the electoral dispute.” The injunction gave a deadline of 24 hours to remove the publications.
