Minister Alexandre de Moraes, of the (Supreme Federal Court), officially began serving the sentences of the five convicts from the coup plot’s action management nucleus. The group includes members of the Jair Bolsonaro (PL) government and members who were already in preventive prisons.
The rapporteur considered the definitive conviction of the soldiers accused of acting as part of the coup attempt completed this Friday (24). The trial ended on December 16 last year and those involved tried to question parts of the decision.
The group includes the former director of the PRF (), who was sentenced to 24 years and six months in prison, (former international advisor to the Presidency), (former advisor to the Presidency), (former member of the Ministry of Justice) and (former executive secretary of the General Secretariat of the Presidency).
Throughout the process, the defenses of the group members stated that there was not enough evidence for a conviction, pointed out inconsistencies in the PGR (Attorney General’s Office) complaint and argued that their clients did not have the competence to act in accordance with what they were accused of.
It is within this nucleus that the Supreme Court judged the cases in the second round of the 2022 elections. Initially, investigations on this topic were carried out separately by the Federal Police, but the PGR decided to add the accusation to the main action regarding the attempted coup.
The trial also dealt with , former advisor for International Affairs to the President. The trip is marked by contradictory versions and was used by the former president’s defense and allies to contest the process.
Martins is accused of having presented the first version of the coup draft. The document contained a series of calls for action. According to the complaint, Bolsonaro asked for edits to the text and then presented the proposal to the heads of the Armed Forces.
They were charged with five crimes: attempted abolition of the democratic rule of law, coup d’état, armed criminal organization, qualified damage and deterioration of listed property.
The final judgment is the end of the process and from when the sentence begins to be effectively served.
Moraes also defined the place of arrest of the other defendants in the main group of the coup plot.
Arrested at the end of last year, former advisor Filipe Martins spent time at the Penal Medical Center, in São José dos Pinhais, in the metropolitan region of Curitiba. The former advisor’s defense claims that the place has better structure and security conditions than the Ponta Grossa prison, in the interior of Paraná, where he was held.
Silvinei Vasques was arrested on December 26th in Paraguay, at Asunción airport, when he tried to board an international flight to El Salvador with a false Paraguayan passport. He reportedly broke the electronic ankle bracelet in Santa Catarina, and the suspicion is that he went by car to Paraguay.
On the same date, Moraes ordered the house arrest of Marília Alencar. In March, she underwent surgery and, since then, has been undergoing post-operative consultations and exams. According to Moraes, there was no news of non-compliance with the precautionary measures imposed.
Marcelo Costa Câmara has been in preventive detention since last June. According to Moraes, the colonel tried to access confidential information about the denunciation of Mauro Cid, former aide-de-camp of the Presidency of the Republic.
