Constitutional annuls expulsion of Daniel Adrião from PS. “It was not a mere formal error”

The Constitutional Court decided to annul the expulsion of the former socialist leadership candidate from the PS. Adrião has already asked José Luís Carneiro for readmission. “Within parties, the rule of law must be respected.”

The former socialist leadership candidate Daniel Adriano reacted this Saturday to the Constitutional Court’s decision to annul his expulsion from the Socialist Party.

“After a long and demanding battle for the defense of my honor, my rights and the democratic principles in which I have always believed, the Constitutional Court decided, unequivocallycancel my expulsion of the Socialist Party”, reads a statement sent to Lusa by the former activist.

“This decision leaves no room for doubt: the expulsion was illegal and legally invalid”, adds Daniel Adrião, who leads the PS.

The case dates back to the end of 2025, when the PS National Jurisdiction Commission decided to expulsion of former socialist leadership candidate for having run in the municipal elections for a parish in Lisbon, against his own party’s list — a decision that was contested by Daniel Adrião.

Adrião defended the legality of his decision at the time, highlighting that “municipal law does not prevent party activists from being part of lists of groups of citizen voters”, and added that, as a member of the National Political Commission, always voted against all processes of expulsion of militants who were part of lists of groups of voting citizens.

The former candidate told Lusa that he has already written the José Luís Carneiroasking for your readmission into the party. “It’s not just about a personal victory, it’s about restoration of legality and the affirmation that, also within parties, the Rule of Law must be respected”, he defended.

For the socialist, the decision has now been annulled “it was not a mere formal error”, having had “serious and concrete consequences” in his political life.

“In September 2025 I was suspended from my militant rights before making any valid decision, I was prevented from participating in national bodies of which I was a part, the National Commission and the National Political Commission, and I was removed from the National Congress of the Socialist Party”, he highlighted.

From Adrião’s perspective, “the respect for the rule of law had to be imposed” to the Workers’ Party. “Given the seriousness of the facts, it is not enough to formally comply with the ruling. I demand a public apology and the clear assumption that a serious error was made”, he demanded.
