AGU hearing takes place this Wednesday (29) at the Senate Constitution and Justice Committee
President Lula’s (PT) nominee to the STF, Jorge Messias, stated this Wednesday (29) that he was totally against abortion. “On my part, there will be no type of activism regarding abortion. I want to leave Your Excellencies at ease regarding this.”
During a hearing at the Constitution and Justice Commission (CCJ) in the Federal Senate, Lula’s nominee highlighted that abortion should be “an object of reprimand”. “I would even like to say that no practice of abortion can be commemorated or celebrated, quite the contrary, it must be the object of reprimand. But that is my personal, philosophical, Christian conception.”
“Whatever the circumstances, it is a human tragedy. Now, we also need to look with humanity at women, teenagers, children, lives. That is why the law established very restricted hypotheses that exclude illegality”, said the AGU, in response to senator Weverton Rocha (PDT-MA).
Messias recalled the opinion he sent to the STF, where he defended the competence of the National Congress to legislate on abortion. “As Attorney General of the Union, I presented an opinion before the Federal Supreme Court (STF) in which I defended, in a very clear and categorical way, the exclusive competence of the National Congress to legislate on the topic of abortion”, he continues.
Lula’s nominee for a vacancy on the STF is undergoing hearings at the Senate’s CCJ this Wednesday (29). In his initial presentation, Messias stated that the Supreme Court needs to keep open to improvement. “The credibility of the STF is a commitment and a need“, said the AGU, citing opposition senator Magno Malta (PL-ES).
“Because of its importance, we need the STF to remain open to improvement. The public perception that supreme courts resist self-criticism and institutional improvement tends to put pressure on the relationship between jurisdiction and our democracy”, stated Messias.
“In a Republic, all power must be subject to rules and restraints”, he added.
Messiah took advantage of the opening speech to make nods to Congressafter conflicts between the Executive, Judiciary and Legislative Powers. “This is what I commit to exercising if it is approved by your Excellencies. The role of constitutional jurisdiction is precisely placed in the process of balancing the Powers.”
“Justice does not take sides. It is not for or against. It does not applaud and does not censor. I believe that this respectful compliance is the starting point for a healthy interaction between constitutional jurisdiction and politics.”
‘Christian Principles’
Evangelical and frequenter of the Baptist Church, Messias mentioned religion in his speech and stated that the Christian values accompany you throughout your life’s journey.
“I must tell you, as a servant of God, that Christian principles accompany me on any journey in my life. I am sure that the secular State does not prohibit considering the Christian ethical basis that applies to our Constitution. It is possible to interpret the Constitution with faith, and not by faith”, he said.
The AGU highlighted that it reached this moment without a hereditary tradition in Justice, but with study e work.
“I am from the Northeast, evangelical, son of the Brazilian middle class, with no hereditary tradition in the Judiciary. I come here through study, through work, through my family, through my friends, brothers through faith in God. And, consequently, through confidence in my life path. A life of discipline and humility, therefore a truly Christian life.”
