A court decision in Spain ordered the payment of compensation of 13.3 million euros to a woman whose child suffered serious neurological damage after a hospital birth. The case, which occurred in November 2019, is associated with “inadequate” medical care during birth and has once again placed the issue of clinical responsibility at the center of the debate.
The Madrid court concluded that there were errors in the monitoring of labor, particularly in terms of monitoring fetal well-being, which would have compromised the timely response of the medical team and influenced the condition in which the baby was born.
According to the portal, the child currently has severe cerebral palsy, accompanied by cognitive limitations and communication difficulties, both receptively and expressively. It is a condition that requires continuous monitoring and specialized care.
According to the same source, an 87% disability was attributed, which means that the child will depend on permanent assistance throughout his life, both in a clinical context and in the most basic daily activities.
Faults identified during delivery
The court found that the medical team did not correctly interpret warning signs during labor, which delayed decisions considered essential. This failure to read clinical indicators was identified as one of the determining factors. Monitoring of fetal status was not adequate, which prevented timely intervention and contributed to the clinical outcome recorded after birth.
The baby was born in conditions considered serious, and was immediately attended to by specialized teams. The health condition required urgent intervention and intensive care. It is worth mentioning that the child was intubated shortly after birth and transferred to a hospital unit with capacity for differentiated neonatal care, where perinatal asphyxia was diagnosed.
Prolonged hospitalization after birth
After the transfer, the newborn remained hospitalized in intensive care, at a stage considered critical for his survival. Medical follow-up focused on stabilizing the clinical condition. The publication adds that, despite the care provided later, neurological damage was already installed, with an irreversible impact on the child’s development.
The court ruled that the compensation amount should reflect not only the harm suffered, but also the child’s future needs, including treatment, support and assistance throughout life. “The compensation must respond to the child’s real needs”, says the same source, highlighting that the decision took into account the prolonged dimension of the consequences.
Responsibility attributed to insurers
The ruling holds insurers associated with the health professionals involved in the birth responsible, determining the payment of a significant part of the amount. According to Notícias ao Minuto, more than six million euros correspond to the direct responsibility of these entities, an amount to which interest is added from the date of the facts and procedural costs.
The overall compensation amount was highlighted as one of the highest awarded in Spain in cases of medical negligence, reflecting the seriousness of the situation. The family’s lawyer said that this is the highest amount awarded so far in this type of process, which reinforces the relevance of the decision.
Court validated version of the accusation
The judge fully accepted the arguments presented by the prosecution, considering the flaws in clinical monitoring during childbirth and their relationship with the final result proven. The decision results from a detailed analysis of the procedures adopted and the conditions under which the birth occurred.
The events occurred at the Sagunto Hospital, in Valencia, when the woman was admitted at 40 weeks of gestation, already in the final stages of her pregnancy. The birth only took place in the early hours of the following day, after several hours of hospital monitoring.
