CNJ Inspectorate cancels creation of penduricalhos – 05/09/2026 – Politics

The National Justice Inspectorate banned payments that exceed the civil service salary cap, annulled or requested investigations into salary sheets in three state courts between Thursday night (7) and early Friday afternoon (8).

The decisions were signed by Inspector Mauro Campbell and covered the Courts of Justice of Paraná, Mato Grosso do Sul and Goiás.

In Paraná, the magistrate annulled the creation of the role of tutor magistrate within the scope of the legal residency program, trainer, postgraduate and undergraduate internship supervisor.

“The rule in question, by establishing bonuses or charges for tutoring, training and supervision functions within the scope of legal residency, conflicts with the essence of the thesis established by the Federal Supreme Court”, he argues.

According to the TJ-PR (Court of Justice of the State of Paraná), the creation of the function had its effectiveness suspended and no payments had been made until that moment.

Despite this, the inspector argued that “the existence of a normative act that provides for such payments, even if temporarily suspended, creates legal uncertainty.”

In relation to the TJ-MS (Court of Justice of Mato Grosso do Sul), the minister ordered the sending of all payrolls for active, inactive and retired magistrates for the month of April this year, in addition to the mirror of payments for May. The information will support the Internal Affairs investigation.

The TJ-GO (Court of Justice of the State of Goiás) was ordered to immediately injunct the payment of all magistrates to the civil service ceiling, which is currently R$46,366.19.

The minister stated that the transfer of any surplus, under any pretext, is prohibited “until a thorough and independent audit of the court’s payrolls is completed.” The inspection must cover, at least, the months of March and April and be carried out by fully sharing databases and paychecks.

Campbell also said that any financial movement, payment of bonuses, compensation or pecuniary advantages intended for civil servants or magistrates must be subject to prior authorization from the Internal Affairs Department, in order to protect the treasury and guarantee transparency, and warned that the management of the TJ-GO will be analyzed based on the legislation on administrative improbity.

The magistracy’s decisions are in line with warnings made by ministers about non-compliance with the court’s decision that aimed to extinguish extra payments for judiciary and in March.

Last Wednesday (6), ministers Flávio Dino, Alexandre de Moraes, Gilmar Mendes and Cristiano Zanin reiterated that the creation and payment of penduricalhos that are not authorized by the court’s thesis on .

The demonstrations were made after several bodies tried to create additional salaries, even after the STF trial to stop part of the frills. , 14 initiatives in courts and Public Prosecutor’s Offices in at least eight states regulated or discussed creating penduricalhos after the decision.

Two days later, the ministers issued a new warning and, through the reclassification of difficult-to-access districts, which usually generate compensation. They also determined the prohibition of receiving amounts in more than one paycheck to ensure transparency.
