Van Hattem and allies try to reverse suspension in the Chamber

Deputies appeal against suspension of mandate due to protest that blocked the Chamber session in 2025

The federal deputies (Novo), (PL-SC) and (União – MS) appealed, on Tuesday (May 19, 2026), to the CCJ (Constitution and Justice Commission) of the Chamber, against suspending their mandates for 2 months because of 2025. The penalty still needs to be approved by the plenary of the Chamber to come into force.

The House’s rules allow the use of the CCJ in cases of alleged procedural failure or abuse in Ethics Council discussions.

Deputies question the union of the 3 representations in a single opinion. They claim that the measure harmed each person’s right to defense.

Em por Van Hattem no Instagram, Zé Trovão said that congressmen suffer political persecution for defending their supporters. “If we are being persecuted for defending you, then that means we are on the right path”he stated. The deputy also stated that his “The only crime was defending amnesty”.

The opinion in favor of the suspension was prepared by Moses Rodrigues (União – CE) and approved by the Ethics Council in the 1st week of May. The Chamber’s Internal Affairs Department presented the action based on images from the plenary’s security cameras.

The CCJ will analyze the appeal before voting in plenary. If the commission rejects the challenge, the process will be analyzed by the deputies, and confirmation of the punishment will depend on a simple majority of the Chamber.

At the end of the video, Van Hattem stated that deputies will appeal “until the last consequences” to maintain mandates. “God willing, in the Constitution and Justice Commission, we will reverse the decision of the Ethics Council with this appeal”he declared.

REMEMBER THE CASE

The episode occurred on August 5 and 6, 2025, when a group of opposition congressmen occupied the main plenary session of the Chamber for more than 30 hours. The protest was motivated by the house arrest of the former president (PL).

The occupation prevented the normal functioning of the House and obstructed the work of the president of the Chamber, (Republicanos-PB), who was only able to resume activities after meetings with the government base and Bolsonaro’s allies.

At the time, Motta warned that preventing the House from functioning could result in the suspension of mandates. The Chamber’s Internal Affairs Department identified the conduct as serious, constituting disrespect for the authority of the Board and an affront to the institutionality of the Legislature. In addition to the 3 processes being voted on today, the Chamber’s management had already applied written censure to all 14 people involved in the riot.
