The Regional Court in Trnava dealt with complaints against last year’s court decision in a closed session on Thursday, May 21. He refused then parole motions former boss of the Banská Bystrica underworld Mikuláš Černák. The court once again opened one of the most followed cases of Slovak justice.
After studying the materials, the judge decided that the entire case will be dealt with again by the District Court in Trnava. “The reason for canceling the contested decision was primarily that, although the district court conducted extensive evidence, it based its decision on only some of the evidence presented,” explained court spokesman Martin Pogádl.
The spokesman further specified what the district court erred in. “In the justification of his decision, he did not state how he evaluated the other evidence presented and what conclusions he drew from them, which made the decision partly unexamined due to the lack of proper justification“, he clarified.
The regional court came to the conclusion that it is necessary to supplement the evidence. At the same time, he considers it necessary to supplement the justification of the decision in a substantial part so that the parties to the proceedings retain their right to a two-instance proceeding. Convicted Černak is currently serving his prison sentence.

With this step, she not only showed that law is her job, but expressed it her own opinion on what, according to her, is currently happening around Černák.
