Clean Record Law is once again in the hands of the Supreme Court – 05/25/2026 – Dora Kramer

There is an action in the virtual plenary voting process that could help the Federal Supreme Court () to deal with the image and soften the negative way in which it has been seen by the population.

The ongoing trial does not take care of flexibility, as they say. It refers rather to the annulment of the basis that governed the approval of the , 16 years ago, which was to purge the claims of perpetrators of illegalities for a long time.

Contrary to the popular will at the time, expressed in a project endorsed by more than 1 million and 300 thousand signatures of Brazilians and unanimously approved by congressmen, last year Parliament decided to change the deadlines for ineligibility for those with dirty records.

The argument, obviously celebrated by lawyers seeking relief for their clients, was that the original text left the offenders out of electoral disputes for too long. Some of the most serious offenders, poor things, were in danger of ending their careers.

In order to correct what they saw as an injustice haunting their comrades, deputies and senators decided to modify the text and reduce the deadlines to the point that, depending on the case, the punishment expired to leave them eligible within the limited period of two years. In theory, they would only be out of the game for one election.

The former judge — the creator of the law, whose constitutionality was confirmed by the STF in 2012 — asked the court to examine the legality of the 2025 Legislative decision. He states, among other arguments, that the relaxation facilitates the infiltration of government agents into the formal branches of politics.

In the rapporteur’s view, this is a measure that comes up against the constitutional prohibition against institutional setbacks. The Supreme Court’s collegiate has until next Friday (29) to decide whether to restore the essence of legislation that represented advances in the means of policy or to agree with the dynamics of periodic forgiveness for transgressions.
