STM schedules judgment on Bolsonaro’s appeal on patent loss

The Superior Military Court (STM) scheduled the 24th of June for the trial of the defense appeal of former president Jair Bolsonaro (PL) so that Air Lieutenant General Joseli Parente is removed from the patent loss process.

In this case, the STM ministers will evaluate the decision of the president of the court, Maria Elizabeth Rocha, who, in March, denied Parente’s request for suspicion in this trial.

The appeal presented by Bolsonaro’s defense alleges that the minister is a suspect in the case after, in interviews given in 2023, defend punishment for the military involved in the January 8 coup acts.

In opinion, the president of the STM denied the allegations. “The grounds used are too empty and insufficient to attribute bias to the Magistrate,” said Rocha. “The Minister’s statements did not make individual mention of a specific subject, with a nominal indication of being investigated or accused related to the facts of 1/8/2023.”

The STM analyzes the process that discusses whether Bolsonaro must be declared unworthy or incompatible with officialdom, which means the loss of his military rank of captain. Bolsonaro was an Army captain. He was sentenced by the Federal Supreme Court (STF) to 27 years in prison for attempting a coup d’état.

Military personnel sentenced to sentences exceeding two years may be subject to an assessment of unworthiness or incompatibility with the service.

According to the Military Public Ministry, Bolsonaro violated eight basic ethical rules from the barracks when organizing a coup against the institutions:

  • Duty of probity and to behave in an unblemished manner in public life;
  • Respect for human dignity;
  • Compliance with laws and orders from competent authorities;
  • Zeal for one’s own moral preparation;
  • Practice camaraderie and the spirit of cooperation;
  • Discretion in their attitudes, manners and written and spoken language, in addition to observing the rules of good manners;
  • Compliance with civil authorities;
  • Fulfillment of your duties as a citizen.

The STM is made up of 15 ministers – 10 of them are military and 5 of them are civilians.
