Eduardo is accused of working in the United States to pressure STF ministers during the trial of the criminal case against Jair Bolsonaro and other defendants at the crucial core of the coup attempt.
According to Moraes, the deputy tried to use sanctions and tariffs applied by the United States as a way to intimidate the Supreme Court and benefit his father. For the rapporteur, the conducts were not simple political demonstrations nor were they protected by freedom of expression or parliamentary activity.
Moraes stated that Eduardo and Paulo Figueiredo took Brazilian court documents to US authorities to try to justify measures against Brazilian authorities. The minister said that the threats were directly related to the trial of Jair Bolsonaro’s criminal case.
The crime of coercion during the process is provided for in article 344 of the Penal Code. It happens when someone uses violence or serious threats to try to influence an authority, party or person acting in a judicial, police or administrative process.
In his vote, Moraes stated that this crime is formal. This means that it is not necessary to prove that the STF felt intimidated or changed its actions. For the minister, it is enough that the threat was appropriate to try to interfere in the trial.
Zanin fully followed the rapporteur. The minister also rejected preliminary arguments from the defense, including the allegation of nullity of the summons by notice and the request for suspension of the process.
