The Minister of the Federal Supreme Court, Gilmar Mendes, returned for trial, this Tuesday (16), the cases regarding the arrests of Felipe Cançado Vorcaro and Henrique Vorcaro, respectively cousin and father of Daniel Vorcaro, owner of Banco Master.
With the return, the cases are once again analyzed by the Second Panel of the STF, which will vote on whether or not to endorse the decisions of the minister and rapporteur of the case, André Mendonça, who determined both arrests.
The expectation is that Gilmar will vote for house arrest or for the freedom of Vorcaro’s father. In previous interviews, the minister has made statements to the effect that it is necessary to act with caution in arrests involving family members of those being investigated, so that justice is maintained.
The Second Panel of the STF is made up of ministers André Mendonça, Gilmar Mendes, Kassio Nunes Marques, Luiz Fux and Dias Toffoli. So far, Mendonça has already presented a favorable opinion on maintaining the prison, which was followed by Fux.
As he considered himself prevented from analyzing the case as rapporteur, Toffoli will not vote on the decision.
This week’s trial will also be a thermometer to understand the position of minister Kassio Nunes Marques, who will need to take a position in light of the facts presented about Daniel Vorcaro and the Banco Master case.
The expectation is that it will be up to the minister to decide whether the vote ends in 3 to 2 to maintain the prison or in a tie, which would benefit the banker’s relatives.
