The First Panel of the Federal Supreme Court formed a majority, this Friday (19), to deny the appeals presented by the defenses of brothers Domingos Brazão and João Francisco Inácio Brazão, known as Chiquinho, convicted of having ordered the murder of councilwoman Marielle Franco and driver Anderson Gomes.
The appeals presented by Chiquinho pointed out alleged contradictions in the course of the process, as well as the restriction of defense in the decision imposed by the Supreme Court in February this year. Among the questions are the dosimetry of the penalty imposed and the challenge to the minimum compensation of R$7 million to repair the damage caused to the victims’ families.
In the second case, both question the lack of evidence that could justify the decision to set the compensation at such a high amount.
Domingos’ defense raised several questions about the conduct of the investigation and the trial itself, also alleging a restriction on the defense due to late access to evidence and the denial of requests for testimony. The defense also tried to rule out the theory that the deputy and Marielle were in a political conflict, which would have motivated the crime.
The minister and rapporteur of the case, Alexandre de Moraes, was the first to vote for rejection, claiming that the defenses presented delaying appeals, which have the sole objective of delaying the beginning of the sentence. The vote was fully followed by ministers Cristiano Zanin and Flávio Dino.
The Court is still awaiting the vote of Minister Cármen Lúcia. The trial takes place in the virtual plenary session of the Supreme Court and will end at 11:59 pm this Friday.
