Faced with these situations, the school board filed a disciplinary proceeding in December 2018, culminating, in July of the following year, with the application of the suspension by the Directorate-General of School Establishments. The teacher resorted hierarchically, but the then Minister of Education rejected the request.

In court, the teacher claimed that the prosecution was too vague, because it did not indicate concrete dates, that the disciplinary report was based on generic statements, without factual support and that the 150 -day suspension was disproportionate. However, the Court of First Instance considered the action unfounded And, under appeal, the judges of the North Central Administrative Court corroborated the decision, maintaining that the prosecution included sufficient elements to guarantee the right of defense.

The judgment underlines that the sanction respects the legal frame of between 60 and 240 days for three infractions and was appropriate to the disciplinary responsibility of the teacher. Although they recognized the absence of disciplinary antecedents as an attenuating factor, the magistrates valued accumulation of infractions as aggravating.

Currently, the teacher is part of the faculty of the Conde de São Bento Agricultural Professional School in Santo Tirso. According to an official source of the Ministry of Education, the teacher appealed to the Supreme Administrative Court in September, awaiting final decision.
