The crime will have involved cleaning contracts worth millions of euros with public entities, including the Air Force, the Navy, Social Security and several universities and polytechnic institutes.
A NCC Facility Services, led by Júlio Vilas Boas and Joaquim Dias, his partner, was a cleaning company that carried out 299 contracts with State entities for a total value of almost 22.5 million euros.
In 2013, a complaint made to the Attorney General’s Office triggered an investigation — the values that NCC presented when applying for public tenders were much lower than those in the competition, which generated suspicions of “tax avoidance”.
The scheme involved the “fictitious acquisition” of workers and “allowed unduly deduct the VAT contained in these invoices and also reduce the value of taxable profit in each year and, consequently, the value of IRPJ to be delivered to the State”.
The company was then able to “present lower budgets than all the competition” and “could even charge values lower than the designated cost price, since it was able to offset losses and capitalize, into profit, undue VAT deductionsresulting from the scheme”.
