The law regarding technical conditions for buildings is changing. From September 2026, the new regulations will enter into force. According to the prepared provisions, the amendment to the act may affect owners of plots and gardens. The regulations regarding fencing of plots and the construction of gates and wickets will change. What does this mean in practice?
The biggest change concerns acute . From September 2026, such fence finishing will no longer be legal. This means that a fence erected up to 2.2 m high will not contain sharp elements, barbed wire, glass finishes and other fragments that may pose a threat to people or animals. So far, the regulations allowed for this type of protection to be placed on fences higher than 1.8 m. The new regulations are intended to harmonize European safety standards.

. The draft regulation also assumes changes regarding the entire infrastructure accompanying fences. For owners, this means that the entrance gate and gate will not be able to open beyond the plot area. Gates at multi-family buildings and public utility facilities will have to meet the access conditions for people with needs. The minimum width of such wickets will be 0.9 m.
Will allotment gardeners have to dismantle fences?
Barbed wires and sharp elements are often a form of security. After changing the regulations, will it be necessary to dismantle a fence that does not meet the new requirements? The law does not apply retroactively and there will be no need to adapt existing fences to the regulations. The regulation will apply to newly erected fences as well as those that will be rebuilt.
