Luciano Bonilha Leão — former music producer convicted of the fire at Nightclub Kiss — was granted progression to the open regime by the Regional Criminal Execution Court of Santa Maria last Friday (30).
He was in favor of the prisoner’s work and study benefits, but requested that a criminological examination be carried out before progression.
According to the TJRS (Court of Justice of the State of Rio Grande do Sul), Luciano served 28% of his sentence (3 years, 1 month and 28 days), with 7 years, 10 months and 2 days remaining. He is in 2025 and has the objective requirement for progression to the open since January 2026.
Luciano will remain under house arrest with electronic monitoring until his formal inclusion in the program. The judge ordered the issuance of the release permit and authorized external work, compatible with the open regime.
Initially, the former producer had been sentenced to 18 years in prison, but on August 26, 2025, the TJRS judges unanimously ruled on the four defendants. In 2021, they were convicted of homicide with possible intent for the deaths of 242 people and injuries to more than 600 victims of the fire.

The fire started after one of the members of the Banda Gurizada Fandangueira fired a pyrotechnic device and the sparks reached the ceiling, which was covered in foam.
The partners of the Kiss nightclub, Elissandro Callegaro Spohr and Mauro Londero Hoffmann, the lead singer of Banda Gurizada Fandangueira, Marcelo de Jesus dos Santos, and the music producer Luciano Bonilha Leão were sentenced on December 10, 2021.

With the change, the sentence was 12 years in prison for the club’s partners, Elissandro Callegaro Spohr and Mauro Londero Hoffmann. Musician Marcelo de Jesus dos Santos and music producer Luciano Bonilha Leão had their sentences reduced to 11 years.
