The minister of the (Supreme Federal Court) recognized the prescription of two crimes for which the former deputy had been convicted and maintained the .
More than nine years in prison for inciting violence against authorities in 2021 — with the recognition of the statute of limitations for the crimes of slander and public incitement, this sentence will decrease.
The minister, however, denied the defense’s request to process infringing embargoes and cited the “absence of the necessary number of acquittal votes (four)”.
This type of appeal is used to question decisions made without unanimity. The problem, however, is that only decisions from classes that have at least two completely divergent votes can be challenged through this appeal route.
Last month, the Attorney General’s Office expressed its support for reducing the sentence. Furthermore, the PGR considered that the former deputy met the requirements for regime progression. Jefferson was pre-emptively arrested on August 12, 2021 and is under house arrest. For Attorney General Paulo Gonet, the period of four years, five months and seven days since arrest should be deducted from the total sentence.
The former deputy was convicted in December 2024. He published videos attacking the democratic rule of law and was convicted of incitement to crime, attacks against the exercise of Powers, slander and homophobia — according to the complaint, the politician tried to prevent the functioning of constitutional powers, especially the Legislative Branch and the Pandemic CPI.
