Partnership provides for the exchange of information on infringements in physical and digital media to ensure compliance with the resolution that prohibits the sale of devices in the country

Anvisa and MPF sign agreement aimed at stopping electronic cigarette trade

The National Health Surveillance Agency (Anvisa) and the Federal Public Ministry (MPF) signed an agreement with the aim of intensifying inspection actions e strengthen the fight against illegal trade of electronic smoking devices, popularly known as electronic cigarettes or vapes.

In a note, Anvisa informed that the agreement aims to guarantee compliance with Collegiate Board Resolution (RDC) 855/2024, which prohibits the manufacture, import, commercialization, distribution, storage, transportation and advertising of electronic cigarettes in the national territory.

“The idea is to unite Anvisa’s technical expertise with the MPF’s power of legal action”, highlighted the agency in the statement.

The agreement will initially be valid for five years, with periodic meetings between the responsible teams. There is no provision for transfer of resources between the parties.

Among the measures provided for in the agreement is the systematic sharing of technical information and data on inspections carried out in physical and virtual environments.

It will be up to Anvisa to provide technical subsidies and information on the actions of the National Health Surveillance System, while the MPF will investigate the infractions identified and coordinate with other control bodies.

The partnership also foresees the development of communication and awareness-raising actions about risks associated with the use of electronic cigarettes as part of public health protection strategies.
