Rio court orders Marielle Franco’s killers to compensate widow

The Court of Justice of the State of Rio de Janeiro sentenced the murderers of councilor Marielle Franco and driver Anderson Gomes, Ronnie Lessa and Élcio Vieira de Queiroz, to pay compensation for moral damages and a monthly pension to councilor Mônica Benício, Marielle’s widow.

The court upheld the request for compensation and set R$200,000 for reflex moral damages, to be paid jointly by the defendants.

The decision also determined a pension of two thirds of Marielle’s income, with 13th salary and vacations plus one third, from the date of the crime until the limit of the victim’s life expectancy (76 years) or until the beneficiary’s death. Marielle was 38 years old when she was murdered.

The court also ensured reimbursement and funding of medical, psychological and psychiatric expenses, to be determined in settlement.

In a note, Mônica Benício stated that the decision is symbolic in nature:

“This is a symbolic victory, which recognizes the interruption of the history that we built together and the future that was denied to us. The fight for Justice for Marielle and Anderson is not about money”, he said.

According to her, “holding those responsible accountable is a fundamental condition for Brazilian democracy to provide a response worthy of the murder of Marielle and Anderson.”

Judgment of the principals

The investigations indicated that the brothers Domingos and Chiquinho Brazão ordered the murder of the councilor to hired killers, and that the former head of the Civil Police of Rio de Janeiro, Rivaldo Barbosa, planned the act, in addition to having hindered the investigation, headed by himself, before the case was elevated to the federal level.

Military Police Major Ronald Alves de Paula and former military police officer Robson Calixto, Domingos’ advisor, will also respond to the crime in the Supreme Court. Everyone is in pre-trial detention.

According to former police officer Ronnie Lessa’s plea bargain, the brothers Brazão and Barbosa acted as masterminds of the crime and Rivaldo Barbosa participated in the preparations for the execution.

Ronald is accused of monitoring the councilor’s routine and passing on the information to the group. Robson Calixto would have handed over the weapon used in the crime to Lessa.

According to the investigation carried out by the Federal Police, Marielle’s murder is related to the parliamentarian’s opposition to the interests of the political group led by the Brazão brothers, who are linked to land issues in areas controlled by militias in Rio.
