Federal deputy Rui Falcão (PT-SP) criticized the statement by the Minister of Justice, Wellington César Lima e Silva, that he sees no problem with the proposal by the Security PEC rapporteur, deputy Mendonça Filho (União-PE), to carry out a popular consultation to reduce the age from 18 to 16 years.
According to Falcão, changing an essential clause in the Constitution could set a precedent for other changes that affect issues linked to human rights.
“The statement attributed to the Minister of Justice is regrettable, that he sees no problem in submitting to popular consultation the reduction of the age of criminal responsibility, an essential clause of the Constitution, which can only be changed by another Constituent Assembly. This could set a precedent to allow a plebiscite or referendum on the death penalty”, says the PT member.
Mendonça’s proposal was not included in the initial version of the amendment, sent by the Ministry of Justice, and was included in an amendment presented by him. The topic must be voted on by Congress after Carnival.
