Five other people also had to be hospitalized after coming into contact with water from the gym’s pool.
The Public Ministry of São Paulo (MP-SP) reported this Tuesday, 10, that opened a civil inquiry to investigate the C4 Gym gym chain, which has franchises spread across São Paulo. Last Saturday, 7th, teacher Juliana Faustino Bassetto, 27 years old, during a swimming class at the unit located in the São Lucas neighborhood, in the east of the capital.
The civil inquiry was opened by the Housing and Urban Planning Attorney’s Office with the aim of determining whether the chain’s franchises operate without the Fire Department’s Auto and Inspection (AVCB). The AVCB is a document that certifies that a building meets the fire and panic safety conditions required by law.

Prosecutor Marcus Vinicius Monteiro dos Santos determines that the academy presents a complete list of units in operation (address, identification of franchisees), details of how franchise agreements are signedin addition to information about possible irregularities.
“According to preliminary information contained in the ordinance, the company operates through a franchise system, and there are indications that some units would operate without the appropriate AVCB,” the prosecutor’s office said in a note.
The Public Prosecutor’s Office also sent letters to the Municipal Government Secretariat, the Health Surveillance and the Fire Department for the carrying out inspections at all the network’s gyms in the capital and requires units to submit reports, licenses, information about AVCBs, among other administrative details.
Juliana’s death is investigated by the Civil Police. According to delegate Alexandre Bento (42nd DP), the main line of investigation is that the death was supposedly caused by toxic gases released from a mixture of chemicals made for cleaning the pool.

In a note, the academy regretted the episode and stated that it provided support to the victims. The owners have not yet given a statement to the police and their defense has not been located.
After the episode, the Vila Prudente sub-prefecture closed the C4 Gym gym due to a “precarious security situation” and also due to the absence of the Operating License Certificate, the permit, since the establishment has two CNPJs linked to the activity carried out at the address.
“It’s a nebulous situation. There are two CNPJs on site”, said delegate Alexandre Bento, who is heading the investigations. “We hope to unravel this when the owners provide clarification,” he added.
In addition to Juliana, five other people felt unwell that could be related to contact with pool water. Four of them are hospitalized, including Juliana’s husband, Vinícius de Oliveira, whose health condition is considered serious.
O general assistant of the academy, responsible for cleaning the pool, who also works as a valet on site, gave a statement to the police this Tuesday. He stated that he receives instructions from the owners via messages, prepares the mixture and usually leaves the solution outside the pool to be thrown into the water by the teachers.
A video obtained by Estadão shows the moment in which the man, identified as Severino da Silva, prepares the mixture. The Adjutant General’s defense claims that he has collaborated with the investigations.
