The president’s (PT) assessment is that the minister, of the (Supreme Federal Court), should stay away from the process regarding , of which he is the court’s rapporteur. The PT member has expressed to allies the opinion that the minister’s continued involvement in the investigation harms the image of the court.
This analysis is shared by at least three people linked to Lula interviewed by Sheet. Although there was no direct meeting between the president and his ministers, the matter was discussed, subject to reservation, between the heads of the palace departments.
In Planalto, the understanding is that one should not focus on the depreciation of Toffoli’s figure, but that the minister’s situation has become difficult and has the potential to compromise the image of the Supreme Court. According to these interlocutors, the ideal procedure would be to remove the minister from the case.
The president reportedly stated that it was necessary to find a “way out” of the issue — in this case, Toffoli’s removal from the rapporteur.
This morning, Lula met with the Attorney General of the Republic, outside the official agenda. In this meeting, the two dealt with police investigations relating to betting and banks, one day after the Federal Police report showed that mentions of Toffoli were found on the cell phone of the former owner of Banco Master, Daniel Vorcaro.
The meeting lasted about half an hour and was held hours before Gonet participated in a session at the Supreme Court in which the case would be discussed. According to Planalto’s assistants, the president and the president had already arranged this meeting, during the opening of the year in the Judiciary, which marked the resumption of trials in the Supreme Court.
On that occasion, as usual, Lula participated and, by choice, gave a speech in which he mentioned the punishment of “crime tycoons”, in the presence of court ministers, including Toffoli. Luiz Fux was the only member who did not participate in person at the opening.

This week, the PF sent Fachin a report in which it said it found mentions of Toffoli on his cell phone and messages pointing to payments made to the company Maridt, which has Toffoli among its partners.

The meeting takes place so that Fachin can inform others about the PF report and the response that Toffoli has already sent to the presidency, denying there are any reasons for suspicion. Behind the scenes at the STF, the reading is that the court is experiencing an unprecedented crisis and that Fachin is once again in a crossfire over how to deal with the intensification of stress.
The tendency is for the president of the STF to deny the allegation of suspicion, as the PF does not have the legitimacy to make a request of this nature. Fachin’s decision must be monocratic (individual) and restricted to this technical issue, without delving into the merits of the relations between Toffoli and Vorcaro.
The meeting at the Supreme Court takes place on the same day that Fachin planned to hold a luncheon between ministers and debate the idea of a code of conduct — an event that has ended, according to a notice sent to the offices on February 4.
