Ministers of the (Federal Supreme Court) assess that the court is currently experiencing an unprecedented crisis with the developments in the investigation into . Internal pressure to leave reporting on the case has increased in the last few hours.
The magistrate, however, has told assistants and friends that he will not give up the process. A response to this effect must be formalized to the president of the STF, this week, within the scope of an allegation of suspicion raised by the PF ().
The PF sent Fachin a report in which it said it found mentions of Toffoli on the cell phone of the businessman, owner of Master, and messages pointing to payments made to the company Maridt, which has Toffoli among its partners.
The allegations led the minister to release two notes — one on Wednesday, stating that the PF’s request was based on “inclusions”, and another this Thursday, in which de Vorcaro, although he confirmed having been a partner in the Tayayá resort.
Behind the scenes at the STF, the reading is that the scenario has worsened for Toffoli and that Fachin is once again in a crossfire over how to deal with the intensification of stress.
Privately, a minister told the Sheet that Fachin will have to be skilled in interlocution with the Federal Senate to try to stop a possible impeachment process against Toffoli, amid campaigns by opposition parliamentarians.
Regardless of Toffoli’s response, the president of the Supreme Court raised suspicions, as he had to make a request of this nature.
The decision must be individual (monocratic) and must not go into the merits of the relationships highlighted by the PF between Toffoli and Vorcaro. Fachin can also submit the discussion to the court’s plenary session, if he deems it necessary.
The president of the STF who made him return to Brasília in the middle of the January recess. According to Fachin’s interlocutors, if he publicly defends Toffoli, he will be contradicting his own speech in favor of ethics, a priority of his management.
Fachin has already been advised by one of his peers not to make “sudden movements” (in relation to , for example) at a moment of vulnerability in the court, under penalty of subjecting the court to a new wave of attacks.
With the Master’s crisis in the STF and with the (Superior Court of Justice) worn out with , ministers assess that the challenge is to restore society’s trust and dispel the perception that the Judiciary would be completely demoralized.
Last week, during debate in the plenary session, Toffoli provided no leaders. “Several magistrates own companies and, not exceeding management, have every right to their dividends.”
