The minister of the (Supreme Federal Court) closed this Wednesday (11) the investigation into an agreement signed between the extinct Lava Jato task force and the NGO Transparência Internacional Brasil.

The minister ordered the archiving following a request made by the (Attorney General’s Office) in 2024. The attorney general, stated that there were no “minimum elements” to continue the investigation and that the case should not even be in the STF.

Toffoli opened the investigation following a request presented by federal deputy Rui Falcão (PT-SP) for the court to investigate whether the cooperation agreement between the NGO and the task force had been illegal.

Before filing, the magistrate contacted all control bodies. He asked the (Federal Court of Auditors), (Comptroller General of the Union), Ministry of Justice and presidencies of the Chamber of Deputies and the Senate to take action.

The NGO has always denied that the cooperation signed with the Public Ministry involved the receipt of resources.

The leniency agreement with J&F, the holding company that controls JBS, provided for the payment of R$2.3 billion in social investments.

“The truth, reiterated and documented countless times, is simple: TI has never received a cent from any leniency agreement or from any company or public authority linked to Lava Jato or any anti-corruption operation in Brazil”, says a note from the NGO.

Transparency International states that it will continue to “resist” and act in the fight against . “TI Brasil suffered attacks from the left, the right and, mainly, from above. We were never intimidated. We never backed down. We never deviated one millimeter from our mission to denounce and combat corruption.”

The TCU also saw no signs of irregularities in the episode.

In the decision in which he archived the investigation, Toffoli stated that “in view of such manifestations, attesting to the ‘absence of minimum elements that would justify the continuation of the investigations’, the opinion for archiving the case must be accepted.”
