The minister, president of the (Supreme Federal Court), defended this Monday (16) that the court seeks self-restraint, respects the division between politics and Justice and safeguards the population’s trust.
“Self-restraint is not weakness, it is a demonstration of strength”, said Fachin during a master class at CEUB (Centro Universitário de Brasília). “The STF is indeed the guardian of the Constitution, but the law must be given what belongs to the law and politics what belongs to politics.”
The Supreme Court is experiencing an unprecedented image crisis, after the revelation of commercial relations between court ministers and the former banker, from . He is under arrest and is the target of an investigation reported by the court itself.
“We can never give up justifying our choices, justifying our decisions in a lucid, sensitive and rational way,” said Fachin. “Without trust there is no legitimacy, and without legitimacy there is no authority to sustain.”
During his speech, the minister also criticized the transfer of decisions of a political nature to the judicial arena, and argued that the Supreme Court is one of the most transparent courts in the world, with sessions broadcast on the internet and television.
Behind the scenes, Fachin tries to articulate the publication of a code of conduct that limits relations between ministers and defendants. Most colleagues resist the idea, however.
