The defense of , former presidential advisor in the government of Jair Bolsonaro (PL), presented a writ of mandamus to the Federal Supreme Court asking for his transfer to a prison in the metropolitan region of Curitiba, with the justification of guaranteeing his physical integrity.
Martins is imprisoned in a prison in Ponta Grossa (PR), in a statement to himself that the place does not have ideal conditions to house him.
The writ of mandamus, signed by lawyer Ricardo Scheiffer Fernandes, was distributed to minister André Mendonça, who is already analyzing another measure of similar content filed by the defense last year.
“During the course of the writ of mandamus already regularly received by this Supreme Court, an official statement came from the prison administration itself recognizing that the prison unit currently responsible for the custody of the petitioner does not have adequate security conditions to guarantee his physical integrity”, says the lawyer.
According to the penal institution, the Ponta Grossa jail is overcrowded, with 912 prisoners for 592 places, a high flow of inmates in and out and difficulty in implementing strict security protocols.
“The administrative document produced by the Regional Coordination of the Criminal Police describes the structural vulnerability of the establishment, characterized by overcrowding, intense prisoner turnover and the essentially transitory nature of the unit, factors that make the adoption of differentiated security measures unfeasible”
Despite arguments from the Paraná prison authorities, the minister (STF) decided to keep Martins’ prison in Ponta Grossa, where he lived. The former presidential advisor was convicted by the STF for participating in the coup plot.
