The Attorney General’s Office (PGR) spoke out, this Monday (23), in favor of house arrest for former president Jair Bolsonaro, convicted in the coup plot trial after losing the 2022 elections.

Provided for in the Code of Criminal Procedure, humanitarian house arrest is an exceptional measure, granted to prisoners with serious health conditions, advanced age or care needs that go beyond the possibilities offered in the prison confinement regime.

Every prisoner benefiting from the regime is monitored 24 hours a day using an electronic ankle bracelet, to ensure that they remain at the indicated address. The request for humanitarian detention may be denied or revoked if the prisoner presents a risk of escape.

Jair Bolsonaro has been hospitalized since the 13th in the Intensive Care Unit (ICU) of the DF Star hospital, in Brasília, after being diagnosed with bilateral bronchopneumonia. The state of health was highlighted by the PGR as a central factor in recommending flexibility in the regime.

In addition to his clinical condition, Bolsonaro is 71 years old, which also makes him eligible for house arrest. Despite meeting two requirements, granting the benefit requires, as a rule, a medical report proving the former president’s weakness; the final decision will be made by Minister Alexandre de Moraes.

Bolsonaro has already been placed under house arrest while awaiting the end of the trial of the coup plot by the Federal Supreme Court (STF), but lost the benefit in November, after breaking his electronic ankle bracelet during the early hours of the morning.

The former president was sentenced by the STF to 27 years and 3 months in prison, in an initially closed regime, for leading the attempt to prevent President Luiz Inácio Lula da Silva from taking office.
