Senate approves inclusion of vicarious violence in the Maria da Penha Law

Text establishes a sentence of 20 to 40 years for vicarious homicide, classified as a heinous crime

The Senate approved this Wednesday (March 25, 2026) the PL (Bill) which includes vicarious violence in and creates mechanisms to expand the protection of women in the context of domestic violence. The text goes to presidential sanction.

A It is characterized by acts carried out against children, dependents or people close to them with the aim of affecting the woman emotionally. The project recognizes this practice in Brazilian legislation and establishes specific guidelines for its repression.

The text also creates the figure of vicarious homicide, that is, when the aggressor kills someone close to the victim for this purpose. In these cases, the penalty will be 20 to 40 years in prison, and the crime will be considered heinous.

The proposal establishes an increase in the penalty if the crime is committed in the presence of the woman, against a child, elderly person or person with a disability, or in breach of a protective measure.

In addition to punishment, the measure has a preventive nature as it seeks to discourage this type of violence and reinforce the protection of victims.

Rapporteur of the proposal in the Senate, senator (PP-MT) stated that, despite the recurrence of cases, there was still no specific provision for vicarious violence in the legislation. According to her, the initiative corrects this gap and strengthens the mechanisms to combat violence against women.
