STF softened, but did not end privileges – 03/26/2026 – Dora Kramer

From what we can understand from the traditional legalese spoken by ministers, we believe that the benefits continue.

Amended, but they allow additional payments of up to 70% of the ceiling established by law, divided into two blocks of 35%. Aside from the language, the accounts also sound complicated. But, for the understanding of those who pay the bill, the thing is clear: payments above the constitutional ceiling of R$46.3 thousand, which now exceeds R$78 thousand, are legal.

In its eagerness to recover from the damage to its reputation, the STF was willing to put an end to the party. In two preliminary decisions, the ministers gave the impression that the idea was to put an end to such nonsense. Illusion shattered in the plenary, jealous —as it should be— in observing “legal security”.

Extra funds secured by legal institutes created over years in which the matter was far from public scrutiny are therefore guaranteed. Unless, the court ruled, it institutes new rules to enforce what was said in the original text of 1988.

Once the issue is transferred to the appropriate forum of the Legislature, the most scandalous absurdities go away, but the little things considered palatable remain. And from what can be inferred from Parliament’s willingness to change the caste of which it belongs, there is zero chance of having a morally and legally acceptable solution.

The legislators’ argument is that this is not an election year issue. Mere delaying maneuver. In fact, in the heat of the campaign would be the ideal time, as it is when those dependent on votes are led to listen to the voice of the streets.

Any questions about what the majority thinks about sustaining the privileges of a minority? Well, that’s why, so that everything stays as it is, they decide to let the season of demands pass until the period of demands on the government begins. Or start over.
