Minister argues that it is a ‘gigantic historical error’ to focus attacks on the STF instead of investigating real criminal factions
Minister Flávio Dino came out in defense of his colleagues on the Federal Supreme Court (STF) this Tuesday (14) after the Parliamentary Commission of Inquiry (CPI) on Organized Crime requested the , classifying the measure as a “injustice”.
In a post on social media, Dino highlighted the institutional commitment to combating crime e criticized the direction adopted by the commission at the end of their work.
The demonstration takes place shortly after senator Alessandro Vieira (MDB-SE) presented the CPI’s final report. The document calls for the indictment of liability crimes of STF ministers Toffoli Days, Alexandre de Moraes e Gilmar Mendesin addition to the Attorney General of the Republic (PGR), Paulo Gonet.
In the text shared on his networks, Flávio Dino pointed out that the STF and the PGR have a “relevant set of judicial decisions against organized crime in Brazil”, acting strictly within the limits of their constitutional powers to target “armed gangs, political crimes and factions in general”.
The judge criticized the collegiate’s stance on divert the focus from street crime to investigate members of the Judiciary. “It is irresponsible to investigate organized crime and not deal with militiamen, drug traffickers, illegal weapons sellers, illegal miners, factions that control territories, killers and gunmen”, stated the minister.
Dino emphasized that it is a mistake to point to the Supreme Court as the “biggest national problem”, calling this narrative a “gigantic historical error, which requires better reflection on the consequences”. He considered that criticism and investigations are legitimate and must exist, as long as they are carried out with “respect for people’s dignity” and with a view to preserving democracy, warning that without strengthening institutions “there are no fundamental rights or future for the Nation”.

CPI conclusions
The commission reaches the end of its activities without having its deadline extended by the president of the Senate, Davi Alcolumbre. The final report, of more than 200 pages, supports the indictment requests in alleged infractions e suspicions of conflict of interest.
The document points out the following infractions against ministers and the prosecutor:
- Toffoli Days: accused of participate in suspicious trials due to indirect business links;
- Alexandre de Moraes: suspected of judge cases in which there would supposedly be impediment due to his wife’s office relations;
- Gilmar Mendes: accused of lack of decorum for canceling investigations and discarding investigation data;
- Paulo Gonet: suspected of “omission” in the progress of investigations against authorities;
In addition to requests for indictment, the report brought proposals for modernization and repression of crime, which include strengthening the Financial Activities Control Board (Coaf), the increased penalty for money laundering crimesa creation of asset control systems for servers and suggestion to create an autonomous Ministry of Public Security. The case of the Master bank, treated by the collegiate as a focus of money laundering for organized crime, was left as suggestion for opening a future CPI of our own.
