The proposal to tighten the Dry Law returned to debate in Congress with a proposal to increase punishments for drivers involved in serious accidents. THE Bill 3,574/2024authored by former deputy Gilvan Máximo, provides for higher fines, prolonged suspension of the driver’s license and expanded financial liability in cases involving victims.
According to the text, when the accident results in death, the fine can reach 100 times the value of a very serious infractioncurrently set at R$293.47. In practice, this would lead to a penalty of R$ 29.347,00in addition to the suspension of the right to drive for 10 years.
In cases of permanent disability of the victim, the fine would be up to 50 times the base value (about R$ 14.673) with suspension of driver’s license for five years.
The project also determines that the driver bears all of the victim’s medical expenses and provides for the payment of additional compensation of up to ten times the value of the very serious finewhich expands the financial impact beyond the administrative penalty.
Focus on serious accidents
The proposal does not change the general rule of the Dry Law, which already provides for zero tolerance for drinking and driving. The focus is to toughen the response in situations with more severe consequences, especially when there is death or permanent disability.

In justification, the author argues that the number of traffic deaths in Brazil remains high and compares the scenario to losses recorded in recent conflicts and crises, defending stricter measures as a way of increasing accountability.
