The defense of the former presidential advisor says that they received, without surprise, the information that minister Alexandre de Moraes ()
Martins, sentenced to 21 years in prison, is already serving his sentence in a prison in Ponta Grossa (PR), but due to a preventive detention ordered at the end of last year.
According to his defense, “this is the continuation of an abuse that has been going on for more than 800 days and an execution of a sentence that, in practice, had already been imposed by Alexandre de Moraes long before any conviction.”
The former advisor spent six months in prison in 2024, accused of having traveled to the USA at the end of the Jair Bolsonaro government. With the presentation of evidence that he did not make this trip, he was eventually released.
This time, the preventive arrest was for having accessed LinkedIn, failing to comply with the order not to have contact with social networks, which Martins denies having done.
“Filipe has already spent 805 days in ‘preventive’ prison, enduring restrictions typical of convicts and others analogous to torture to which not even convicts can be subjected,” says the defense.
The former advisor’s representatives cite ten days in solitary confinement without lighting and 50 days in isolation in the Ponta Grossa prison unit, despite the fact that the prison authority of the Paraná government said that the place poses risks to his integrity.
“At other times in recent history, prolonged preventive detentions were denounced as a form of torture, but not in this case, not with Filipe Martins — in this case they do not even generate institutional embarrassment”, says the defense.

Martins’ conviction was for his participation in the production of the so-called “coup draft”, which would have supported the plot led by Jair Bolsonaro. He denies, however, that this happened.
“Filipe was sentenced based on the narrative of a ‘ghost minute’ never located in his files, devices, accounts or communications, nor included in the records, and of a meeting in which he was proven not to be part of”, states the defense.
