The Union’s attorney general, defended this Wednesday (29) (Supreme Federal Court) and said that every Power must be subject to containment.

The statement, made at the Constitution and Justice Commission of the (CCJ), has similarities with the speech adopted by the minister at, in 2017.

The Judiciary’s contention discourse pleases parliamentarians, who complain about what they call the court’s advances on Legislative prerogatives in recent years.

It didn’t take long, however, for Moraes to become the target of criticism for what they say are practices that go beyond the powers of the Power.

On the occasion, the minister who is attributed with unorthodox conduct in conducting the fake news inquiry defended what he called “judicial self-restraint”. He argued that intervention should be minimal, preventing the court from becoming a “positive legislator”.

“Potential clashes must be resolved in a balanced and harmonious application of the principle of separation of state functions”, declared Moraes.

In his opening speech, he stated that an activist judge could ignore the Constitution, its history and previous court decisions to impose his own interpretations on the other Powers.

Appointed by the then president (), Moraes was questioned in a session that lasted 11 hours and 39 minutes – one of the longest and most resistant in the Senate.

Messias, in turn, said this Wednesday that it is the STF’s duty to improve itself. He defended that the court has “discretion, self-restraint and institutional deference to other Powers”.

“The Supreme Court needs to convince society that it has ethics and control mechanisms in place. […] Every Power must be subject to rules and restraints”, he said.
