The judge Eva do Amaral Coelhomember of the TJPA (Court of Justice of Pará)had a verbal confrontation with the judge Pedro Pinheiro during a session of the 12th Section of Criminal Law last Monday (27).
The disagreement occurred during the analysis of a request for you have a bodyat which point the judge showed impatience when asked about the reasons for her vote and asked her colleague to “pay attention”.
Clash in plenary
The central point of the discussion was a case involving a man detained for alleged association with the faction Red Command.
Judge Pedro Pinheiro repeatedly questioned whether there was the presence of narcotics in the case or whether the arrest was based solely on mentioning the defendant’s name on a seized cell phone.
After the insistence, Eva do Amaral Coelho responded directly: “I’ve already explained three times, doctor, that there are no drugs in the mix. Just pay attention”.
The judge reiterated that the custody was based on an internal registry of the faction found on a third party’s cell phone, but that there was no evidence of drug possession in the act.
Outcome of the trial
Despite the heated atmosphere in the 12th Section, the rapporteur maintained her position in favor of relaxing the defendant’s imprisonment, arguing that there were insufficient reasons for maintaining the prison.
The final decision, however, was postponed after the judge Wánia Lúcia Silveira request a view of the process.
History of controversies
The judge’s behavior occurred a few weeks after she won.
In a session held on April 9, the judge classified the cut of pendants as a path to “regime of slavery” na magistratura.
At the time, she criticized the injunction that established the constitutional ceiling of R$46,366.19 and prohibited bonuses without federal law.
“Soon, we will be on the list of those employees who work under slavery”he stated at the time, alleging that judges are being seen as “villains” and “thugs”.
