The decision by the Municipal Public Order Secretariat was taken to, according to the body, give “the right to full defense, after the establishment’s appeal”.
“Seop also took into account that there was no recurrence of the establishment, following a fine from Procon Carioca at the beginning of April”, stated the ministry, in the statement.
The bar was fined R$9,520 by Procon (Special Secretariat for Consumer Protection and Defense) on the 4th for “conduct that constitutes abusive and discriminatory practices”.
The punishment was imposed after a complaint by councilor Pedro Duarte (PSD) made based on a photo shared by the establishment itself on its social networks. He classified the case as .

“The technical defense highlights that the favorable outcome was due to the rigorous application of legal technique, which demonstrated the primacy of Freedom of Expression. Symbolic demonstrations and geopolitical criticism are constitutionally protected fundamental rights and cannot be confused with administrative or criminal offenses”, says the note signed by lawyers Diogo Flora, André Matheus and Lucas Mourão.
