STF ministers reinforce ban on penduricalho payments

Dino, Moraes, Gilmar Mendes and Zanin prohibit remuneration beyond those already authorized; ministers demand monthly accountability from courts

The minister of (Federal Supreme Court), Flávio Dino, determined this Wednesday (May 6, 2026), that public bodies do not make payments of extra funds without express authorization from the Court. The magistrate also ordered the detailed monthly publication of the amount received by each member of courts, Public Ministries, audit courts, Public Defenders and Public Attorneys of the Union, the States, the Federal District and the municipalities. Dino’s decision was signed after the (General Attorney’s Office of the Union) the health benefit of its members to include expenses for sports, in vitro fertilization and expenses for relatives. The minister stated that non-compliance with the rules could lead to criminal and administrative liability for managers.

In the order, Dino reinforced the need to observe the limit of 35% above the constitutional ceiling for extra funds, by the Supreme Court in March 2026. The minister declared that courts and public ministries must indicate the exact items for each amount paid to their members.

COORDINATED DECISIONS

Minister Alexandre de Moraes decided in the same direction. He stated that payments of a remunerative or compensatory nature not provided for in the STF decision of March 25 are absolutely prohibited. Moraes declared that managers could face criminal charges. Here’s the (PDF – 119 KB).
