Minister of the STF requested information from the Presidency of the Republic and Congress on the topic; The deadline for shipping is 5 days
Minister Alexandre de Moraes, from rapporteur was chosen for the two actions being processed in the Court that question the validity of the so-called Dosimetry Law. the text allows for the reduction of sentences for those convicted of the extremist acts of January 8, 2023 and could benefit the former president (PL).
Moraes gave the Presidency of the Republic and Congress 5 days to send information about the law. After shipping, the ea (Attorney General of the Union) will have 3 days to comment on the processes. Read the of the decision (PDF – 118 kB).
The actions were presented by (Brazilian Press Association) and the Psol-Rede federation.
The request is to suspend the law until the judgment in the STF and for the Court to consider sections of the approved legislation unconstitutional.
ABI’s action asks the Court to consider the following points unconstitutional:
- permission for crimes against democracy “inserted in the same context” do not have the penalties added together;
- the possibility of reducing sentences for crimes committed in crowds;
- 2 items that change the Regime progression provided for in the Criminal Execution Law.
The Dosimetry Law project was vetoed by the president (PT) in January. Congress overturned the vetoes last week. The President of the Senate, (Brazil-AP Union), the text on Friday (May 8, 2026).
