President vetoes additional penalty of loss of nationality due to unconstitutionality

The President of the Republic, António José Seguro, vetoed for unconstitutionality the decree that created the additional penalty of loss of nationality, following a ruling by the Constitutional Court (TC), returning it to the Assembly of the Republic.

The veto, which the Constitution imposes in these cases, was published today on the official website of the Presidency of the Republic on the Internet, after on Friday the TC, unanimously, declared the second version of this decree unconstitutional, as had happened with the first, both approved by PSD, CDS-PP, Chega and Initiative Liberal.

“In accordance with the provisions of article 279, no. 1, of the Constitution, the President of the Republic returned to the Assembly of the Republic Decree no. 49/XVII, which amends the Penal Code, creating the additional penalty of loss of nationality, since the Constitutional Court ruled, in the context of preventive inspection, that the rules contained in no. 1, paragraphs a), b), c), d), were unconstitutional. e) and h) of paragraphs 4 and 5 of article 69-D, to be added to the Penal Code by article 2 of Decree of the Assembly of the Republic nº 49/XVII”, reads the note.
