The existence of public records related to tax debts continues to raise doubts among many Portuguese taxpayers, especially at a time when several State services can be consulted digitally through online platforms. Among these mechanisms is a list made available by the Federal Revenue Service that identifies citizens and companies with debts to the Tax Authorities.

According to the portal, the so-called ‘black list’ can be consulted directly on the Finance Portal and includes taxpayers who did not regularize the amounts owed within the legal deadline established by the tax authorities.

Who can appear on the list

The disclosure applies to individuals and legal entities with debts exceeding 7,500 euros. According to the same source, names remain publicly accessible when there is no payment, guarantee presented or waiver recognized in relation to the amount in question.

The document is organized into distinct categories. The division is made between individual taxpayers and companies, with each group then separated by brackets associated with the amount of existing debts.

What data is available

In addition to the taxpayer’s name, the list also includes the Individual Taxpayer Registry (CPF) and the range corresponding to the global amount of the debt. The Finance Portal explains that these elements constitute the categories of data treated in this public disclosure system.

It should be noted that the consultation can be made through a few clicks on the portal, without the need for complex procedures or specific access requests.

How to remove your name from the list

Exclusion from the list can happen through the regularization of the tax situation or by formally contesting the debt. Taxpayers also have the possibility of complaining when they consider that the inclusion was undue. The Finance Portal also says that rights to rectify, eliminate or limit data processing can be exercised, particularly in situations related to prescriptions, guarantees provided or judicial challenge processes.

The list changes frequently. Notícias adds to Minuto that the removal of names can occur daily, as long as the services confirm payment of the debt or validate the guarantee presented by the taxpayer. New names are added monthly. According to the same source, taxpayers who meet the requirements for public disclosure of tax debts are included in the list.

There are situations that can generate changes

The Finance Portal also allows specific cases in which a taxpayer may appear temporarily associated with amounts lower than the minimum limit set for a given bracket. This can happen due to partial cancellation of the debt or guarantees considered insufficient.

Whenever there are irregularities in the payment method or in the guarantee presented, the taxpayer may reappear on the list until the tax situation is definitively regularized.

Consultation remains accessible online

The public disclosure of these tax data continues to be available through the Finance Portal and is part of the transparency tools used by the Tax Authority. The consultation is open and can be carried out by anyone with internet access.

For many taxpayers, the possibility of seeing their name associated with tax debts in a public register also ends up working as an incentive to settle disputes with the tax administration.
