Moraes maintains preventive detention of those responsible for Marielle’s murder

The Minister of the Federal Supreme Court (STF) Alexandre de Moraes ordered on Monday (25) the maintenance of the preventive detention of the brothers Domingos and Chiquinho Brazão and three other people convicted in the case of the murder of councilwoman Marielle Franco and driver Anderson Gomes.

In the decision, Moraes stated that no new facts had emerged capable of modifying the procedural situation of the accused, convicted of planning, ordering and trying to cover up the deaths in February this year. As a result, the prisons are maintained until the action becomes final, at which stage no further appeals can be made and the sentence begins to be executed.

In addition to the Brazão brothers, the measure reaches Rivaldo Barbosa, former head of the Civil Police of Rio de Janeiro; Ronald Paulo Alves Pereira, former PM major; and Robson Calixto, former military police officer and former advisor to Domingos at the Court of Auditors of the State of Rio de Janeiro (TCE-RJ).

The First Panel of the STF sentenced Chiquinho and Domingos Brazão to 76 years and three months in prison for the murders of Marielle and Anderson, the attempted murder of advisor Fernanda Chaves and for armed criminal organization. Chiquinho is under humanitarian house arrest, granted for health reasons.

In addition to losing their public positions, the five accused are ineligible. Domingos Brazão served as advisor to the TCE-RJ, while his brother had his mandate as federal deputy revoked in April 2025 due to excessive absences.

Ronald Paulo Alves Pereira was sentenced to 56 years for double qualified homicide and attempted qualified murder; Rivaldo Barbosa, to 18 years for obstruction of justice and passive corruption; and Robson Calixto to 9 years for joining an armed criminal organization.

Last week, the STF made Rivaldo a defendant in a new criminal action related to the case. He will respond to police chief Giniton Lages and Civil Police Commissioner Marco Antonio de Barros Pinto for criminal association and obstruction of justice.

According to the Attorney General’s Office (PGR), the group worked within the Rio de Janeiro Civil Police to disrupt homicide investigations and ensure impunity for crimes linked to criminal organizations, including the case of Marielle and Anderson. The defenses deny the accusations.
