The court returned the indictment against Dušan Kováčik to the prosecutor: He blames him for serious mistakes

The judge of the Specialized Criminal Court (ŠTS) rejected the indictment from April 20, 2021 against the former head of the defunct Special Prosecutor’s Office, Dušan Kováčik. He returned the matter to the prosecutor because he found serious procedural errors in violation of the accused’s right to defense and to a fair trial. According to the judge, the prosecutor did not submit complete files, including all the evidence secured in the preliminary proceedings, and the indictment does not meet the requirements of the Criminal Code. This follows from information confirmed for TASR by ŠTS spokeswoman Iveta Pulman Erdélyiová. The Aktuality.sk portal drew attention to the case.

The indictment against Dušan Kováčik related to a crime establishing, organizing and supporting a criminal group, the crime of accepting a bribe, the crime of abuse of authority of a public official and the offense of endangering confidential information and confidential information.

Spokesperson for the General Prosecutor’s Office (GP) of the SR Zuzana Drobová informed that “The Specialized Criminal Court, Banská Bystrica workplace, by resolution of May 19, 2026, rejected the indictment filed by the prosecutor of the former Office of the Special Prosecutor’s Office of the Slovak Republic and returned the case to the prosecutor.” Against the resolution in question, the prosecutor of the serious crime department of the General Prosecutor’s Office of the Slovak Republic filed a complaint, which, according to her, will be decided by the Supreme Court of the Slovak Republic.

Minister of Justice Boris Susko (Smer-SD) filed an appeal in the summer of 2024 in the case of the then duly convicted former special prosecutor Dušan Kováčik. At the same time decided to suspend the execution of the prison sentence pending the decision of the Supreme Court (NS) of the Slovak Republic on the appeal.

On December 11, 2025, the Supreme Court of the Slovak Republic decided on the appeal of the Minister of Justice in the case of Dušan Kováčik. He annulled the 2022 ruling of the Supreme Court of the Slovak Republic from 2022, as well as the ruling of the ŠTS from 2021. The ŠTS ordered him to decide on the matter again. In May 2022, the Supreme Court of the Slovak Republic sentenced Dušan Kováčik to eight years in prison for accepting a bribe and disclosing information from files. He also imposed a fine of 100,000 euros on him. The ŠTS originally imposed a 14-year prison sentence on him in September 2021.
