For more than a decade, the minister was among the priority targets of the Brazilian left. proves that he learned one of the main techniques of his former detractors: blaming the messenger for the message.
When asked about the negative repercussions of Caso Master at the Lisbon Forum, “Gilmarpalooza”, once said: “Maybe people who don’t want to go to the forum and want to be sympathetic to the ideology of Sheet are echoing this.” Asked about the crisis of confidence experienced by the STF, he used it again: “I don’t want to exempt those who have responsibility from responsibility, but it seems to me that you place the court in a Polish corridor; then the Sheet does research and reveals frustration”.
According to Gilmar, it is (almost) all the fault of the Coup Press. What it is not, is up to “Faria Lima”, the classic comprehensive metaphor intended to attribute responsibilities to a hidden subject and, simultaneously, to be part of the political current associated with the Planalto. Did the CVM fail? Yes of course. Smart banks resold CDBs from ? Yes, obviously. But, in the minister’s speech, the “systemic crisis” works like a magic wand that exempts the STF from the duty to investigate its own members.
Toffoli? Moraes? “This is certainly being investigated,” replied the illusionist. In fact, he ignored the PF report on the first and, not happy, declared that his colleague had no conflict of interest, preliminarily acquitting him. As for the second, Orwell: the investigations target the expert who would have leaked the suspected contract, but not the contract itself.
Fachin and the code of ethics, is there a division in the court? There, Gilmar exercises internal contradiction. 1) “There is no internal division”; 2) The code proposal “generated an environment of certain lack of intelligence”; the gesture was “inappropriate” because “whoever wants to lead the court needs to produce unity”. The second part of the answer would serve as a more appropriate title for the interview: Fachin makes the mistake of prioritizing transparency over unity.
Swapping the judge’s cloak for the anthropologist’s mantle, Gilmar makes light of the concept of culture: “There are many things in the German code of ethics that do not match our culture.” The correct sentence would be something like this: the German code does not match the yellow-green patrimonial tradition, which entwines our elites in a web of exorbitant privileges, undue favors and shady deals. Precisely therein lies Gilmar’s aversion to the “ideology of Sheet“, that is, to the demand for equality before the law.
In theory, the Justice system operates in a separate sphere from politics. Gilmar doesn’t recognize the border. Seven years later, is it time to close the exceptional fake news inquiry? “If the environment of radicalism is maintained, and everything indicates that it will be maintained, given the electoral intensification, the investigation is necessary.”
In the universe of law, inquiries have determined objects, that is, facts that have already occurred. In the parallel universe installed by the STF, the “necessary” investigation has the purpose of elucidating facts that could occur in the future. In other words: the court responsible for protecting the Constitution decided to amend it, converting itself into a Moderating Power.
