The Electoral Court also analyzed Rodrigo Bacellar’s request against conviction for abuse of political and economic power in the 2022 elections
The Superior Electoral Court (TSE) rejected this Tuesday (2) the resource of the Public Electoral Ministry (MPE) that requested direct elections for the buffer mandate of the Rio de Janeiro government. The score was 5 to 2.
The rapporteur, minister Ricardo Villas Bôas Cueva, for abuse of political and economic power in the 2022 elections. The judge understood that the the decision of the Electoral Court deflated the discussion about the loss of mandate and revocation of the diploma.
The ministers André Mendonça, Dias Toffoli, Antonio Carlos Ferreira and Kassio Nunes Marques accompanied understanding. The magistrate Floriano de Azevedo Marques opened divergence e voted to accept the MPE’s appeal. He was accompanied by the minister Estela Aranha.
With the decision, the TSE places end to discussion about elections to the Guanabara Palace. The Federal Supreme Court (STF) was awaiting the judgment of the Electoral Court to decide whether the claim will be direct or indirect. Currently, the president of the Rio de Janeiro Court of Justice (TJRJ), Ricardo Couto de Castro, temporarily holds the position of governor of the state.

Also in the trial, the TSE rejected unanimously the appeal presented by Cláudio Castro against his conviction of ineligibility until 2030. However, the Electoral Court accepted the challenge regarding the fine.
The TSE also judged the appeal presented by the former president of the Legislative Assembly of Rio de Janeiro (Alerj) Rodrigo Bacellar (União Brasil). Unanimously, the Electoral Court rejected the objection. The former state deputy was convicted in the same case as Cláudio Castro.
