TSE: Kassio repeats Moraes and is included in a group of actions – 06/08/2026 – Politics

In his first weeks as president of the (Superior Electoral Court), the minister repeated the minister and included himself among the ministers who will receive electoral propaganda actions at the court relating to the 2026 elections.

With this, he joined the list of magistrates who could be selected as those responsible for the (-RJ) campaign’s request against research by the AtlasIntel institute.

This Monday (8), . The decision by the president of the TSE was taken in a preliminary (provisional) manner and will still be analyzed by the other ministers this Tuesday (9).

When Kassio assumed the presidency of the electoral court, the group of auxiliary judges, responsible for analyzing electoral propaganda issues, was incomplete and consisted only of minister Estela Aranha. In an ordinance published on May 22, the minister included his deputy and himself.

In general, substitute ministers and ministers appointed as representatives of the legal profession are appointed to report cases of electoral propaganda.

In an already unusual move, in August 2022, Moraes, at the time president of the TSE, appointed minister Cármen Lúcia of the (Supreme Federal Court) to form this group. Months later, already halfway between the first and second rounds, he was included among the ministers appointed to analyze the propaganda cases and pointed out “the exceptional volume of cases in the second round of the 2022 elections and the qualified speed inherent in the achievements of competence of the auxiliary judges”.

Even though the cases are subsequently analyzed by the court’s plenary session, the magistrates who oversee these processes have the power, for example, to grant or not grant preliminary injunctions, which may or may not later be confirmed by the entire court.

When filing the lawsuit against Atlas, on May 18, asking for the injunction to be granted even before the research was released, Flávio’s campaign already requested that the case be forwarded to the presidency of the TSE and, therefore, to Minister Kassio.

“First of all, considering the incompleteness of the special propaganda analysis commission, which prevents even the free selection of representations among the respective auxiliary judges, it is requested that the present case be exceptionally forwarded to the Presidency of the House, considering the absolute urgency of the request for an injunction”, said the initial petition.

Days later, the minister published the ordinance that updated the composition of the group that analyzes propaganda and determined that the case be drawn freely. “In view of the publication of Ordinance No. 235/2026/TSE, which designates auxiliary judges for electoral propaganda, I forward the files to the Judiciary Secretariat so that they can proceed with free distribution”, determined the minister.

as to Sheet showed, Kassio. The minister even said he wanted to prioritize the right of reply over content removal measures throughout the campaign, for example. This would be connected to the judge’s vision of freedom of expression.

In his inauguration speech, the minister defended, for example, that one should not “incur into excesses incompatible with the democratic rule of law”. “To fulfill this mission, we must act with independence, balance and prudence,” he said at the time.
