The PEC (Proposed Amendment to the Constitution) on Flexible Work, presented by the senator (PL-RN), has declared support from 38 senators. THEanother 26 are against, according to a survey by the Poder360.
Of the 81 members of the House, 4 said they still analyzed the text, 4 preferred not to express their position and 8 did not respond to contacts from this digital newspaper. For a PEC to be approved, 3/5 of the senators are required, that is, 49 votes in favor.
The President of the Senate, (União Brasil-AP), sent the proposal to the CCJ (Constitution and Justice Commission) on May 28. However, there is still no forecast for a vote on the matter in the collegiate body.
A of Flexible Work creates an alternative hiring model based on hours actually worked. Under the proposal, employers and workers will be able to opt for the traditional regime provided for in the CLT (Consolidation of Labor Laws) or the in which the remuneration would be calculated according to the workload completed.
In this format, benefits such as FGTS, vacations and 13th salary would be paid in proportion to the hours worked. The text also establishes that individual contracts will prevail over collective agreements on issues related to working hours.
The proposal was presented as an alternative to the PEC approved by the Chamber of Deputies, which reduces the journey from a 6 X 1 scale to a 5 X 2 scale.

Senate bars withdrawal of signatures
Despite having signed the PEC, the senators (Republicans-MG), (PL-RJ) e (Podemos-PA) requested the withdrawal of their support. The requests were by the Senate.

In a note sent to Poder360Zequinha said he had decided to review his position after meeting with representatives of workers in Pará and assessed that the proposal could weaken agreements between employees and employers regarding working hours.
