Argentina maintains home of January 8 convict

Judge authorized change of Wellington Firmino’s apartment after risk of eviction from previous one in Buenos Aires

The Argentine court decided to maintain house arrest in the country of the Brazilian motorcycle courier, Wellington Firmino, who awaits a decision on to Brazil, where he was sentenced to 17 years in prison for participating in the acts of January 8, 2023.

The decision came after Firmino changed apartments, contrary to a previous determination by judge Daniel Rafecas, from –the same person who authorized the maintenance of house arrest.

The court decision considered the particular circumstances of the case. Rafecas assessed that Firmino faced the risk of eviction from his previous apartment and classified the authorization as “exceptional solution” given the consolidated situation.

According to the Firmino had left the apartment where he lived and moved to another property in the same city, which contradicted Rafecas’ previous determination. The judge had established that any change of residence would require prior judicial approval.

According to the report, the Brazilian informed DAPVE (Department of Support for People under Electronic Surveillance) that he would make the change and informed the new address. The electronic ankle bracelet continued to function normally throughout the process.

Rafecas chose to provisionally authorize the stay in the new location and ordered DAPVE to carry out verification of the technical and socio-environmental conditions of the new property. The evaluation will confirm whether monitoring using an electronic ankle bracelet is feasible.

Firmino was granted house arrest in December 2025. Argentina detained the Brazilian in November 2024, when he tried to flee to the United States after being convicted of the acts of January 8, 2023.

The Brazilian court sentenced the motorcycle courier for attempted coup d’état, among other crimes related to the acts. Argentina complied with Brazil’s extradition order by detaining Firmino.
